When a Fatwa Doesn’t Sit Well: Whom Should You Follow?

Question:

Last month you said that if one gives his own land to someone for cultivation, he may take profit, but if it is rented land, he should not take a share of the profit. If some fatwas given by you or others do not sit well in my heart, how should I decide? Should I assume that the one more knowledgeable than me is correct? Or should I follow what seems correct to me?

Answer:

That is, you should not accept something just because a scholar, group, or jama‘ah says it. If we present a hadith and explain it, believing that it supports a view, and you see that the hadith does not support that meaning, then you should follow what is correct according to your understanding. But it should not be based on whims.

If you already held a position and do not want to change it out of pride, that is wrong. If you sincerely analyze the hadith and genuinely see that the meaning is not as claimed, then you may reject that explanation. But if you reject it merely because you do not want to change your previous stance, that is following desires, and that is not acceptable.

You must examine the evidence available to you. Not everyone has access to all information. Based on what reaches you, analyze sincerely. You are not required to blindly imitate (taqlid) someone in religion.
